5.1 Judge.me

For rating reminders we use the services of the following provider: Judge.me Ltd., c/o Buckworths, 2nd Floor, 1-3 Worship Street, London, England, EC2A 2AB, United Kingdom

Only based on your express consent in accordance with Article 6 Paragraph 1 Letter a GDPR, we transmit your email address and, if necessary, other customer data to the provider so that they can contact you with a review reminder by email.

You can revoke your consent to us or the provider at any time with future effect.

We have concluded an order processing agreement with the provider, which ensures the protection of our site visitors' data and prohibits unauthorized disclosure to third parties.

When data is transferred to the provider location, an appropriate level of data protection is guaranteed by an adequacy decision by the European Commission.

5.2 When you contact us (e.g. via contact form or email), personal data will be processed - exclusively for the purpose of processing and answering your request and only to the extent necessary for this purpose.

The legal basis for processing this data is our legitimate interest in answering your request in accordance with Article 6 paragraph 1 letter f GDPR. If your contact is aimed at a contract, the additional legal basis for the processing is Article 6 paragraph 1 letter b GDPR. Your data will be deleted as soon as your concern has been finally clarified and there are no legal retention obligations or other necessary retention reasons. Deviating from this, the storage periods described in section 5.3 apply to the use of the digital customer assistant and the resulting support emails.

5.3 Digital customer assistant

Note: We offer a digital, AI-powered customer assistant on our website. You communicate with an automated system. Answers are generated based on your input and, if you authenticated using the official Shopify customer account, the order information required for your question. The answers may be incomplete or incorrect and are not a substitute for binding legal, payment or other professional advice. If you are unsure or upon request, please refer to customer service.

Please do not enter passwords, one-time codes, full payment details or other sensitive information in the chat box. Email address and verification code are processed exclusively in the official Shopify customer account login; the chat itself does not request these access data.

Processed data

For general questions, we process the chat message entered, the conversation context required for the specific answer as well as technical query and security data (e.g. time, browser/device information, IP address where technically necessary and a randomly generated short-lived session or correlation ID). We only use the data that is necessary to process the respective request.

After successful Shopify customer account authentication, we can retrieve minimized order data for the specific question, in particular order number, order date, fulfillment or shipping status and - if necessary for the question - tracking information. Item positions are only displayed if this is necessary for the specific question or is explicitly asked for. We do not provide full customer profiles, passwords, one-time codes, customer access tokens or payment details as regular chat content. A payment method may only be mentioned in general form if this is necessary for the answer.

Purposes and legal basis

We process the chat data to process your service request and to provide the customer assistant. If the request concerns a specific order or an existing contract, the processing is carried out to carry out pre-contractual or contractual measures in accordance with Article 6 paragraph 1 letter b GDPR. For voluntary general service questions, we base the processing after a documented balancing of interests on Article 6 paragraph 1 letter f GDPR (interest in secure, efficient and user-friendly customer service). The processing of technically necessary security data is also carried out on the basis of Article 6 paragraph 1 letter f GDPR.

Use of redacted and no longer directly assignable examples for quality purposes or to maintain the shared knowledge base will only occur if separate, voluntary consent has been obtained for this purpose in accordance with Article 6 Paragraph 1 Letter a of the GDPR. Consent can be revoked at any time with future effect. In the API configuration intended for this wizard, chat data is not used for general model training.

Recipients and processors

The following service providers can be used for the customer assistant: Shopify International Limited and Shopify Inc. for shop, customer account authentication and authorized access to your own orders; Hetzner for the backend operated by the person responsible; and OpenAI for the server-side generation of a response from the respective minimized context. Cloudflare only processes assistant data if the specific assistant traffic is actually routed through Cloudflare.

OpenAI is only addressed on the server side via the API. The API key is not delivered to the browser, Shopify theme, or an extension. The required order processing contracts or data processing addenda are concluded and documented before the respective activation. The specific service provider configuration and the applicable subcontractor and transfer information are relevant in each individual case.

Storage duration

The conversation context is only kept in a short-lived server-side buffer and is discarded no later than 30 minutes after inactivity. A complete chat transcript is not permanently archived. Voluntarily released, edited quality or learning examples will be deleted after 90 days at the latest. Expired Shopify authentication sessions and OAuth transactions are removed via the scheduled purge run. Statutory retention periods and required security periods for unavoidable technical evidence remain unaffected.

To track support routing, we store technical transaction documents for a maximum of 90 days from their creation. These contain a random reference, times as well as shipping and checking status, but neither the summary of your request nor your reply address. The support email sent will be processed separately in the support mailbox.

The newly set up regular database backups are kept on a rolling basis for a maximum of 30 days. A restore cleans up expired application data before regular use. For separate archives and historical backup copies, their respective purposes and retention rules apply.

Pure support emails without a legal retention requirement will be deleted 90 days after documented receipt of the concern. Statutory retention obligations and storage required to assert, exercise or defend legal claims remain unaffected.

Third country transfers

If service providers process data outside the European Economic Area, this will only be done on the basis of an applicable adequacy decision or suitable guarantees, in particular standard data protection clauses, and the relevant DPA/AVV. Before live operation, the region actually used, the activated configuration and the transfer basis are checked and documented in the internal directory.

Forwarding to our customer service

If you would like support from our customer service, you can have your request forwarded from the chat. We will show you a summary before shipping. Only after you have confirmed this and provided an email address for our reply will the summary and your reply address be sent to our customer service. You will receive our reply by email and do not have to return to the chat.

We use Microsoft 365 or Exchange Online to send and process these emails. The processing takes place to process your request on the legal basis described under “Contacting us”.

6) Data processing when opening a customer account

In accordance with Article 6 paragraph 1 letter b GDPR, personal data will continue to be collected and processed to the extent necessary if you provide it to us when opening a customer account. You can find out which data is required to open an account in the input mask of the corresponding form on our website.

It is possible to delete your customer account at any time and can be done by sending a message to the above address of the person responsible. After deletion of your customer account, your data will be deleted provided that all contracts concluded regarding it have been completely processed, there are no statutory retention periods to the contrary and we have no legitimate interest in continuing to store it.

7) Use of customer data for direct advertising

Subject to your express consent in accordance with Article 6 Paragraph 1 Letter a of the GDPR, the provider also carries out a statistical evaluation of the success of newsletter campaigns using web beacons or tracking pixels in the emails sent, which can measure opening rates and specific interactions with the content of the newsletter. Device information (e.g. time of access, IP address, browser type and operating system) is also collected and evaluated, but is not merged with other data sets.
You can revoke your consent to newsletter tracking at any time with effect for the future.

The only mandatory information for sending this reminder is your email address. Providing further data is voluntary and may be used to address you personally. 8) Data processing for order processing

8.1 If necessary for contract processing for delivery and payment purposes, the personal data we collect will be passed on to the commissioned transport company and the commissioned credit institution in accordance with Article 6 Paragraph 1 Letter b GDPR.

If we owe you updates for goods with digital elements or for digital products on the basis of a corresponding contract, we will process the contact details you provided when ordering in order to inform you personally as part of our legal information obligations in accordance with Article 6 Paragraph 1 Letter c GDPR. Your contact details will be used strictly for the purpose of communicating updates owed by us and will only be processed by us for this purpose to the extent that this is necessary for the respective information.

To process your order, we also work with the following service provider(s), who support us in whole or in part in the implementation of concluded contracts. Certain personal data will be transmitted to these service providers in accordance with the following information.

8.2 Transfer of personal data to shipping service providers

-DHL

As a transport service provider, we use the following provider: DHL Paket GmbH, Sträßchensweg 10, 53113 Bonn, Germany

We will pass on your email address and/or telephone number in accordance with Article 6 Paragraph 1 Letter a of the GDPR to the provider before delivery of the goods for the purpose of agreeing on a delivery date or to announce delivery, provided that you have given your express consent to this in the ordering process. Otherwise, for the purpose of delivery in accordance with Article 6 Paragraph 1 Letter b GDPR, we will only pass on the name of the recipient and the delivery address to the provider. The data will only be passed on to the extent that this is necessary for the delivery of the goods. In this case, prior coordination of the delivery date with the provider or delivery notification is not possible.

The consent can be revoked at any time with future effect from the person responsible above or from the provider.

8.3 Use of payment service providers (payment services)

-Apple Pay

If you choose the “Apple Pay” payment method from Apple Distribution International (Apple), Hollyhill Industrial Estate, Hollyhill, Cork, Ireland, the payment will be processed via the “Apple Pay” function of your iOS, watchOS or macOS-operated device by charging a payment card stored with “Apple Pay”. Apple Pay uses security features built into your device's hardware and software to protect your transactions. In order to approve a payment, you must enter a code previously specified by you and verify it using the “Face ID” or “Touch ID” function of your device.

For the purpose of payment processing, the information you provided during the ordering process, along with the information about your order, will be passed on to Apple in encrypted form. Apple then encrypts this data again with a developer-specific key before the data is transmitted to the payment service provider of the payment card stored in Apple Pay to carry out the payment. Encryption ensures that only the website through which the purchase was made can access the payment details. After the payment is made, Apple sends your device account number and a transaction-specific, dynamic security code to the originating website to confirm the payment success.

If personal data is processed during the transfers described, the processing takes place exclusively for the purpose of payment processing in accordance with Article 6 paragraph 1 letter b GDPR.

Apple retains anonymized transaction information, including the approximate purchase amount, the approximate date and time, and whether the transaction was successfully completed. Anonymization completely excludes any personal reference. Apple uses the anonymized data to improve Apple Pay and other Apple products and services.

When you use Apple Pay on iPhone or Apple Watch to complete a purchase made through Safari on Mac, the Mac and the authorization device communicate over an encrypted channel on Apple's servers. Apple does not process or store any of this information in a format that can be used to identify you. You can turn off the ability to use Apple Pay on your Mac in your iPhone's settings. Go to "Wallet & Apple Pay" and turn off "Allow payments on Mac."

Further information on data protection with Apple Pay can be found at the following internet address: https://support.apple.com/de-de/HT203027
- Google Pay

If you choose the payment method “Google Pay” from Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland (“Google”), the payment will be processed via the “Google Pay” application on your mobile device running at least Android 4.4 (“KitKat”) and with an NFC function by debiting a payment card stored with Google Pay or a payment system verified there (e.g. PayPal). In order to approve a payment via Google Pay in the amount of more than €25, you must first unlock your mobile device using the verification measure that has been set up (e.g. facial recognition, password, fingerprint or pattern).

For the purpose of payment processing, the information you provided during the ordering process, along with the information about your order, will be passed on to Google. Google then transmits your payment information stored in Google Pay to the source website in the form of a unique transaction number, which is used to verify a payment made. This transaction number does not contain any information about the real payment details of your payment methods stored with Google Pay, but is created and transmitted as a unique, valid numerical token. For all transactions via Google Pay, Google only acts as an intermediary to process the payment process. The transaction is carried out exclusively between the user and the source website by debiting the payment method stored in Google Pay.

If personal data is processed during the transfers described, the processing takes place exclusively for the purpose of payment processing in accordance with Article 6 paragraph 1 letter b GDPR.

Google reserves the right to collect, store and evaluate certain process-specific information for every transaction made via Google Pay. This includes the date, time and amount of the transaction, merchant location and description, a description provided by the merchant of the goods or services purchased, photographs you included with the transaction, the name and email address of the seller and buyer or the sender and recipient, the payment method used, your description of the reason for the transaction, and, if applicable, the offer associated with the transaction.

According to Google, this processing is carried out exclusively in accordance with Article 6 Paragraph 1 Letter f of the GDPR on the basis of the legitimate interest in proper accounting, verification of transaction data and the optimization and functionality of the Google Pay service.

Google also reserves the right to combine the processed process data with other information that is collected and stored by Google when you use other Google services.

Further legal information about Google Analytics 4 can be found at https://business.safety.google/intl/de/privacy/, https://policies.google.com/privacy?hl=de≷=de and under https://policies.google.com/technologies/partner-sites

Demographic characteristics
Google Analytics 4 uses the special “demographic characteristics” function and can use it to create statistics that make statements about the age, gender and interests of site visitors. This is done by analyzing advertising and information from third parties. This allows target groups for marketing activities to be identified. However, the collected data cannot be assigned to a specific person and will be deleted after being stored for a period of two months.

As an extension to Google Analytics 4, Google Signals can be used on this website to create cross-device reports. Among other things, this makes it possible to evaluate movement patterns (so-called heatmaps), which show the duration of page visits as well as interactions with page content (e.g. text input, scrolling, clicks and mouse-overs). Pseudonymization fundamentally excludes any direct personal reference. There will be no merging with clear personal data collected about you in any other way.

10) Retargeting/remarketing and conversion tracking

10.1 Meta Pixel

Within our online offering we use the “Meta Pixel” service from the following provider: Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland (“Meta”)

If a user clicks on an advertisement we place on Facebook and/or Instagram, the URL of our linked page is expanded by a parameter using “Meta Pixel”. After redirection, this URL parameter is then entered into the user's browser by a cookie that our linked page sets itself.

On the one hand, this makes it possible for Meta to determine the visitors to our online offering as a target group for the display of advertisements (so-called “ads”). Accordingly, we use the service to only show the Facebook and/or Instagram ads placed by us to users who have shown an interest in our online offering or who have certain characteristics (e.g. interests in certain topics or products, which are determined based on the websites visited), which we transmit to Meta (so-called “Custom Audiences”).

On the other hand, the “meta pixel” can be used to track whether users were redirected to our website after clicking on an advertisement and what actions they took there (so-called “conversion tracking”).

The data collected is anonymous to us, so it does not allow us to draw any conclusions about the identity of the user. However, the data is stored and processed by Meta so that a connection to the respective user profile is possible and Meta can use the data for its own advertising purposes.

All processing described above, in particular the setting of cookies to read information on the device used, will only be carried out if you have given us your express consent to do so in accordance with Article 6 Paragraph 1 Letter a of the GDPR. You can revoke your consent at any time with future effect by deactivating this service in the “cookie consent tool” provided on the website.

We have concluded an order processing agreement with the provider, which ensures the protection of our site visitors' data and prohibits unauthorized disclosure to third parties.

The information generated by Meta is usually transferred to a Meta server and stored there; In this context, there may also be a transfer to Meta Platforms Inc. servers in the USA.

For data transfers to the USA, the provider has joined the EU-US Data Privacy Framework, which ensures compliance with European data protection levels on the basis of an adequacy decision by the European Commission.
